Terms of Use

Please read these Terms before using Whenmark. By installing or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. About Whenmark

Whenmark is a lightweight Android utility that lets you create items, record when an activity was last completed, calculate elapsed time, and retain a local completion history. The App does not require registration, an account, payment, a subscription, or access to a social network.

2. Eligibility and Acceptance

You may use the App only if you can legally enter into these Terms under the laws that apply to you. If you use the App on behalf of an organization, you represent that you have authority to bind that organization. Your continued use after an updated version of these Terms becomes effective constitutes acceptance of the updated Terms, to the extent permitted by law.

3. License

Subject to these Terms, Whenmark grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, and use the App on Android devices that you own or control, solely for lawful personal or internal purposes.

4. Acceptable Use

You agree not to:

5. Your Content and Local Data

You retain responsibility for the names, notes, dates, categories, and other content you enter. The App stores this content locally on your device. You are responsible for the accuracy of your records, maintaining device security, and preserving any information you cannot afford to lose. Clearing App storage, uninstalling the App, resetting the device, or certain system events may permanently delete local data.

6. No Account, Payment, or Subscription

The current version does not offer user accounts, paid features, in-app purchases, or subscriptions. If any of these features are introduced in the future, additional terms and disclosures may apply before you use them.

7. Not Professional Advice or an Emergency Service

Whenmark is an organizational utility only. It does not provide medical, legal, financial, safety, maintenance, or other professional advice. Elapsed-time calculations and user-entered reminders should not be treated as a substitute for professional guidance, manufacturer instructions, safety inspections, or emergency services. You remain responsible for deciding when and how to perform any activity.

8. Availability, Updates, and Changes

We may update, modify, suspend, or discontinue all or part of the App at any time. Updates may be required for compatibility, security, or continued use. We do not guarantee that every feature will remain available, that the App will work on every device or Android version, or that errors will always be corrected.

9. Third-Party Platforms

Your download and use of the App may also be subject to Google Play, Android, device-manufacturer, and telecommunications-provider terms. Those providers are responsible for their own products and services. These Terms do not modify any agreement between you and a third party.

10. Intellectual Property

The App, including its software, interface, visual design, branding, and related materials, is owned by or licensed to Whenmark and is protected by applicable intellectual-property laws. Except for the limited license in these Terms, no rights are transferred to you.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR AVAILABILITY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHENMARK AND ITS OWNER, DEVELOPER, PUBLISHER, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, BUSINESS, GOODWILL, OR USE, ARISING FROM OR RELATED TO THE APP OR THESE TERMS. WHERE LIABILITY CANNOT BE EXCLUDED, IT WILL BE LIMITED TO THE LOWEST AMOUNT PERMITTED BY APPLICABLE LAW. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED.

13. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Whenmark and its owner, developer, publisher, affiliates, and licensors from claims, losses, liabilities, and reasonable costs arising from your unlawful use of the App, your violation of these Terms, or your infringement of another person’s rights.

14. Termination

These Terms remain in effect while you use the App. Your rights under these Terms end automatically if you materially violate them. You may stop using the App at any time by uninstalling it. Provisions that by their nature should survive termination, including intellectual-property, disclaimer, liability, and dispute provisions, will survive.

15. Governing Law and Consumer Rights

These Terms are governed by the laws applicable in the developer’s place of establishment, without regard to conflict-of-law principles, unless mandatory consumer law in your country or region requires otherwise. Nothing in these Terms limits any non-waivable consumer rights available to you. Before publication, the developer should replace this general clause with a jurisdiction-specific clause reviewed for the developer’s actual legal entity and location.

16. Severability and Entire Agreement

If any provision is found unenforceable, it will be enforced to the greatest extent permitted and the remaining provisions will remain in effect. These Terms, together with the Privacy Policy and any additional terms presented for a specific feature, form the entire agreement regarding your use of the App.

17. Changes to These Terms

We may update these Terms to reflect changes to the App, law, or our operations. The revised Terms will display a new effective date and will be made available through the App and/or the related public webpage. Where required, we will provide additional notice or request renewed consent.

18. Contact

The developer and publisher responsible for these Terms is Whenmark.
